End Of Labour Exemptions For Tech Sector In K’taka?

The Karnataka government is considering the termination of labor law exemptions for technology companies, a move set to have possible implications for the IT industry in Bengaluru. These exemptions, which have been in place for several years, may come to an end in May 2024, subject to further decision.

Currently, around 1.2 million men and 600,000 women are employed in over 8,700 IT and biotechnology companies in the state. These technology firms have enjoyed exemptions from labor regulations, aimed at fostering their growth, not only in Bengaluru but throughout Karnataka.

The decision to revisit these exemptions comes in response to concerns raised by the labor department regarding issues like random dismissals, ID blocking, extended working hours, and workplace harassment. If the exemptions are discontinued, labor officials will be able to oversee retrenchment, closures, and layoffs in the IT sector, just as they do in other sectors.

Karnataka Labor Minister Santosh Lad emphasized the need to reconsider these exemptions, highlighting instances of unfair terminations and workplace harassment. He expressed his intention to consult with all stakeholders and make a decision in the best interest of employees.

The additional labor commissioner for industrial relations, G Manjunath, pointed out that the exemptions initially granted in 2014 and extended in 2019 were in response to industry requests. The standing order defines the working and service conditions of employees, ensuring that protocols are followed before terminating an employee’s service.

The proposed changes are a response to increased employee terminations during the COVID-19 pandemic. Officials from the Labor department aim to protect job stability for workers, even in the tech sector.

This move, if implemented, may impact the IT industry’s labor practices in Bengaluru and the state, bringing technology companies in line with labor regulations that apply to other sectors. It remains to be seen how this potential change will affect the industry’s growth and employment landscape in Karnataka.
